Vome User Agreement

1. Acceptance of Terms

Welcome to Vome ("Vome," "we," "our," or "us"), a revolutionary AI girlfriend chat application developed to provide immersive virtual romantic experiences. By downloading, installing, registering for, or using the Vome application (the "Service"), you ("User," "you," or "your") agree to be bound by this User Agreement ("Agreement"). If you do not agree to all terms and conditions of this Agreement, you must not use the Service.

We reserve the right to modify this Agreement at any time. When we do, we will revise the "Last Updated" date at the top of this Agreement. Your continued use of the Service after the revised Agreement is posted constitutes your acceptance of the revised Agreement.

2. Description of Service

Vome provides users with access to a platform featuring diverse AI characters with distinct personalities, intelligent conversation systems, personalized customization options, and immersive experience design. The Service allows users to engage in virtual interactions with pre-designed AI characters (including but not limited to Emma and Sophia) and create custom AI characters with personalized appearances, personalities, and interests.

The Service is provided on an "as is" basis, and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age, you must have parental or guardian consent to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3.2 Account Creation

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

4. User Obligations

You agree to use the Service only for lawful purposes and in accordance with this Agreement. You shall not:

Use the Service to transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
Engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service;
Attempt to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service;
Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose without our prior written permission;
Modify, adapt, translate, or reverse engineer any portion of the Service;
Remove any copyright, trademark, or other proprietary rights notices contained in or on the Service;
Use the Service to violate any applicable local, state, national, or international law;
Create or distribute AI characters that infringe upon the intellectual property rights or privacy rights of any third party;
Use the Service in a manner that could cause harm to minors or encourage harmful behavior.

5. Intellectual Property Rights

5.1 Vome's Intellectual Property

The Service and all content, features, and functionality thereof (including but not limited to all information, software, text, displays, images, video, audio, designs, pre-designed AI characters, and the collection, arrangement, and assembly of all content) are owned by Vome or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

This Agreement grants you no right to use the Vome name, logo, trademarks, or any other proprietary insignia of Vome.

5.2 User-Generated Content

You retain all rights to any content you create, upload, or submit through the Service ("User Content"), including custom AI character designs and conversation data. However, by submitting User Content to the Service, you grant Vome a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the foregoing license for all User Content you submit.

6. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and disclose information about you. By using the Service, you consent to our collection, use, and disclosure of information as described in the Privacy Policy.

We collect and process user data solely for the purpose of providing and improving the Service, including enhancing AI character interactions and personalizing user experiences. We will not share your personal information with third parties except as described in the Privacy Policy.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Vome does not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; or that the Service or the servers that make it available are free of viruses or other harmful components.

The Service is designed to provide virtual companionship experiences and does not constitute a real romantic relationship or professional emotional counseling. Users should not rely on the Service as a substitute for real human interaction or professional advice.

8. Limitation of Liability

IN NO EVENT SHALL VOME OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OR INABILITY TO USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL VOME'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT OF $100.00 USD.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of this Agreement.

Upon termination, your right to use the Service will immediately cease. Sections 5, 7, 8, 10, 11, and 12 of this Agreement shall survive termination.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States of America and the State of California, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to this Agreement or the Service shall be brought exclusively in the federal or state courts located in California, and you consent to the personal jurisdiction and venue of such courts.

11. Dispute Resolution

Before filing any legal action against Vome, you agree to first attempt to resolve the dispute by contacting our customer service team at tovometeam901@outlook.com to seek a mutually acceptable resolution. If we are unable to resolve the dispute within 30 days, you may pursue legal remedies as provided by law.
